  1. Can distinctions be made between ‘real’ 3rd strike crimes and ‘technical’ felonies resulting in excessively harsh sentences?

  2. @William: Yes. I have not done any real work on this, but I know some numbers exist.

    Table 4 has a summary (from 2004, but covering a decade of data). Keep in mind that these (I think) were the final crimes they committed (strikes one and two may have been different):

    37%: Crimes Against Persons (violent crimes including Robbery, Assault With a Deadly Weapon, Assault/Battery)

    30%: Property crimes

    23%: Drugs

    10%: Other crimes (61% of these were illegal firearm possession)
